    Position Description and Related Responsibilities
    Specific responsibilities include, but are not limited to, the following:
    Serves as federal regulatory counsel, providing advice and counsel to all levels of management and multiple corporate client groups primarily on matters subject to utility regulation by the U.S. Environmental Protection Agency (“EPA”), state environmental agencies and other federal regulators.
    Monitors new rulemaking and policies and performs research and analysis of the Company’s factual and legal position regarding various regulatory and related matters.
    Analyzes applicable law and supports the development of strategies to mitigate risk and comply with existing and potential environmental and other federal regulation, including supporting the Company’s participation in regulatory and legal proceedings.
    Advises and provides counsel on environmental legal matters such as air quality, water quality, wastes and byproducts (including coal combustion residuals and hazardous wastes), remediation, and spill or release response, with the assistance of outside counsel as needed.
    Advises on discrete areas of utility-specific federal regulation (such as FCC licensing, pole attachments, and federal contracting).
    Advises on and assists in the development, implementation and oversight of Company policies, procedures, and controls for compliance.
    Provides necessary training to Company personnel to ensure overall corporate compliance.
    Represents the Company in regulatory proceedings before the EPA and other state environmental and federal regulatory agencies that potentially may include motion practice, discovery, oral arguments, examining witnesses, preparing briefs, audit data requests and interviews of Company personnel, with support of outside counsel as determined appropriate.
    Provides counsel on permitting and compliance matters, supporting the preparation and filing of various compliance documents.

    Minimum Qualifications

    + Advising on data privacy/protection and related technology and cybersecurity issues;

    + Developing policies and guidance regarding data projects and processing, confidentiality, security and other data-related provisions in proposals, client contracts, and services agreements with vendors;

    + Providing legal advice and assistance when responding to a data loss/breach (including regulatory notifications);

    + Advising on the data protection and wider data implications of new technologies, including mobile applications, use of cloud, AI/machine learning and other IT platforms;

    + Advising on and negotiating contractual provisions relating to data protection and security;

    + Managing multiple cases/matters/projects and/or teams of internal and/or external resources; and,

    + Consensus building, including for difficult or unpopular courses of action necessitated by legal or regulatory requirements.
